Tech­ni­cal requi­re­ments on the par­ti­ci­pant side

We use the online ser­vice “Zoom” for online mee­tings and consultations.

Par­ti­ci­pa­ti­on via the online ser­vice “Zoom” works quite straight­for­ward on almost all end devices, PCs and lap­tops and is pos­si­ble in almost all brow­sers. Howe­ver, it is best to down­load the Zoom app and par­ti­ci­pa­te via this app. Here you can click “Join a mee­ting” and then enter mee­ting ID and passcode.

A sta­ble inter­net con­nec­tion is required.

We gene­ral­ly recom­mend atten­ding on a lap­top or PC, as pre­sen­ta­ti­ons are easier to read on lar­ger screens.

Loudspeakers/headphones/headset: In order to hear the con­tents of the online semi­nar, you must of cour­se have head­pho­nes or loud­spea­k­ers con­nec­ted to your PC/laptop. If you want to make your own con­tri­bu­ti­ons, you must have a micro­pho­ne con­nec­ted. In this case it is recom­men­ded to use a head­set. A web­cam is requi­red to trans­mit your image as a par­ti­ci­pant. Group semi­nars do not neces­s­a­ri­ly requi­re you to par­ti­ci­pa­te with sound and visi­on; here you can ask your ques­ti­ons by vir­tu­al hand signal or in the chat. Howe­ver, if the seminar/consultation is desi­gned for exch­an­ge and direct com­mu­ni­ca­ti­on, we ask you to make sure that image and sound trans­mis­si­on is pos­si­ble on your part.

Plea­se note that we are gene­ral­ly not respon­si­ble for any dis­rup­ti­ons that occur due to non-obser­van­ce of the tech­ni­cal requi­re­ments on your side.

Desk­top PC or notebook/laptop:

Plea­se use a desk­top PC or notebook/laptop to par­ti­ci­pa­te in your online event.
Ope­ra­ting System:

Win­dows 7 or a more recent ver­si­on
Mac OS X ver­si­on 10.8 or hig­her
Inter­net Access:

Ide­al­ly, access is via DSL / cable with at least 256Kbit/s band­width. We recom­mend 512Kbit/s.
Working head­set and camera:

Plea­se use a head­set in your online event. This will signi­fi­cant­ly impro­ve the sound qua­li­ty for you and the other par­ti­ci­pan­ts.
Also, make sure that the head­set is con­nec­ted to the com­pu­ter and is set as the out­put medi­um.
If you are atten­ding your event with a desk­top PC, an exter­nal web­cam is recom­men­ded.

Regis­tra­ti­on and data storage

Regis­tra­ti­on is done online on our homepage.

We use the Sim­ply Sche­du­le Appoint­ments plug­in to book appoint­ments.
- Types of data pro­ces­sed: inven­to­ry data (e.g. names, addres­ses), cont­act data (e.g. email, pho­ne num­bers), con­tent data (e.g. ent­ries in online forms), usa­ge data (e.g. web­sites visi­ted, inte­rest in con­tent, access times), meta/communication data (e.g. device infor­ma­ti­on, IP addres­ses).
- Data sub­jects: Com­mu­ni­ca­ti­on part­ners, users (e.g. web­site visi­tors, users of online ser­vices).
- Pur­po­ses of pro­ces­sing: cont­act requests and com­mu­ni­ca­ti­on.
- Legal bases: con­sent (Art. 6 para. 1 p. 1 lit. a. DSGVO), con­tract per­for­mance and pre-con­trac­tu­al inqui­ries (Art. 6 para. 1 p. 1 lit. b. DSGVO), legi­ti­ma­te inte­rests (Art. 6 para. 1 p. 1 lit. f. DSGVO).

Inde­pen­dent of this regis­tra­ti­on plat­form, we store your data in the form of invoices, lists of par­ti­ci­pan­ts, con­fir­ma­ti­ons of par­ti­ci­pa­ti­on and cor­re­spon­dence in elec­tro­nic form in our EDP sys­tem. We do not pass on your data to third parties.

After receipt of your regis­tra­ti­on you will recei­ve a con­fir­ma­ti­on of regis­tra­ti­on by e‑mail. We will send you the invoice sepa­ra­te­ly, also by e‑mail. The par­ti­ci­pa­ti­on fee is to be trans­fer­red to the account indi­ca­ted on the invoice within the pay­ment peri­od of two weeks — but in any case befo­re the semi­nar beg­ins. In the case of regis­tra­ti­ons at short noti­ce, if pay­ment can­not be made befo­re the start of the semi­nar / befo­re the start of the online con­sul­ta­ti­on, the invoice amount is due within the sta­ted pay­ment deadline.

You will recei­ve the par­ti­ci­pa­ti­on link after registration.

Invoice dis­patch by mail

Her­bak Con­sul­ting S.L.U. usual­ly sends invoices in elec­tro­nic form (invoice dis­patch by e‑mail).

Method of payment

Con­sul­ting fees are gene­ral­ly paid in advan­ce by bank trans­fer. Excep­tio­nal­ly, in case of short-term regis­tra­ti­on, the fee will be due within the sta­ted pay­ment term in the invoice.

Mini­mum num­ber of participants

Events with a sta­ted mini­mum num­ber of par­ti­ci­pan­ts can only take place if the sta­ted mini­mum num­ber of par­ti­ci­pan­ts is rea­ched. In the event of a can­cel­la­ti­on, you will be noti­fied in good time and your semi­nar fee will be refunded.

Can­cel­la­ti­on

Up to four weeks befo­re the online semi­nar / start of online con­sul­ting, you can can­cel free of char­ge at any time.
Bet­ween the fourth and the second week (14 days) befo­re the start of the semi­nar, we char­ge a pro­ces­sing fee of 70% of the semi­nar fee.
From the second week befo­re the start of the semi­nar, 90% of the semi­nar fee is due.
If par­ti­ci­pan­ts do not show up wit­hout noti­fi­ca­ti­on, we reser­ve the right to with­hold or char­ge the full price.

Semi­nar cancellation

In case of can­cel­la­ti­on of the semi­nar, or of a spea­k­er, we will offer you an alter­na­ti­ve date if pos­si­ble. If the ter­mi­nal alter­na­ti­ves are not pos­si­ble for you, you can eit­her choo­se an equi­va­lent alter­na­ti­ve semi­nar, recei­ve a vou­ch­er from us for the semi­nar fee paid or we will refund the par­ti­ci­pa­ti­on fee.

Legal basis for data pro­ces­sing for semi­nars and online seminars:

The legal basis for data pro­ces­sing when regis­tering for and con­duc­ting semi­nars and online semi­nars is Art. 6 (1) lit. b) DSGVO. Based on the regis­tra­ti­on for our online semi­nars, a con­trac­tu­al rela­ti­onship ari­ses bet­ween Her­bak Con­sul­ting S.L.U. and you.

Offer of online seminars

Our offer of online semi­nars and online con­sul­ta­ti­ons is exclu­si­ve­ly for infor­ma­ti­on and trai­ning pur­po­ses. This offer takes place online. During con­sul­ta­ti­ons it is always pos­si­ble to ask sub­ject-rela­ted ques­ti­ons. We do not record our semi­nars. For the pur­po­se of fol­lo­wing up on online semi­nars, any ques­ti­ons asked by semi­nar and con­sul­ta­ti­on par­ti­ci­pan­ts are processed.

What data is processed?

In order to par­ti­ci­pa­te in an online seminar/consultation, you must par­ti­al­ly enter your name and, if appli­ca­ble, your email address on the respec­ti­ve plat­form. Meta­da­ta is also pro­ces­sed: Semi­nar topic, descrip­ti­on, par­ti­ci­pant IP addres­ses, device/hardware information.

Text, audio and video data: you have the opti­on of using the chat, ques­ti­on or sur­vey func­tions in an “online mee­ting”. To this ext­ent, the text ent­ries you make are pro­ces­sed in order to dis­play them in the online training.

The came­ra and micro­pho­ne are only acti­ve if you allow them to be. If par­ti­ci­pan­ts wish to make spo­ken con­tri­bu­ti­ons, the micro­pho­ne and, if neces­sa­ry, the came­ra can be enab­led on a case-by-case basis. Howe­ver, the came­ra and micro­pho­ne will never be enab­led wit­hout your con­sent. In order to enable the dis­play of video and the play­back of audio, the data from the micro­pho­ne of your ter­mi­nal device as well as from any video came­ra of the ter­mi­nal device will be pro­ces­sed accor­din­gly for the dura­ti­on of the release.

In exch­an­ge-ori­en­ted con­sul­ta­ti­ons, semi­nars or work­shops, it is pre­cis­e­ly the inter­ac­tion that is con­cep­tual­ly inten­ded and the­r­e­fo­re the came­ra and micro­pho­ne release is desi­red. Nevert­hel­ess, you also deci­de here whe­ther image and sound are released. Befo­re par­ti­ci­pa­ting in our ser­vices, plea­se check in advan­ce whe­ther you wish to take part in such a seminar.

Note: Inso­far as you access the web­site of “Zoom”, the pro­vi­der of “Zoom” is respon­si­ble for data pro­ces­sing. You can par­ti­ci­pa­te in an online semi­nar via “Zoom” by down­loa­ding and using the “Zoom” app. If you do not want to or can­not use the “Zoom” app, then the basic func­tions can also be used via a brow­ser ver­si­on, which you can also find on the “Zoom” website.

Data pro­ces­sing out­side the Euro­pean Union

“Zoom” is a ser­vice pro­vi­ded by a pro­vi­der from the USA. A pro­ces­sing of per­so­nal data the­r­e­fo­re also takes place in a third coun­try. We have con­cluded an order pro­ces­sing agree­ment with the pro­vi­der of “Zoom” through our con­trac­tu­al rela­ti­onship, which com­pli­es with the requi­re­ments of Art. 28 DSGVO. An ade­qua­te level of data pro­tec­tion is gua­ran­teed on the one hand by the “Pri­va­cy Shield” cer­ti­fi­ca­ti­on of Zoom Video Com­mu­ni­ca­ti­ons, Inc. and on the other hand by the con­clu­si­on of the so-cal­led EU stan­dard con­trac­tu­al clau­ses. SSL encryp­ti­on when visi­ting our homepage

To pro­tect the secu­ri­ty of your data during trans­mis­si­on, we use sta­te-of-the-art encryp­ti­on methods (e.g. SSL) via HTTPS.

Chan­ges to our pri­va­cy policy

We reser­ve the right to adapt this data pro­tec­tion decla­ra­ti­on so that it always com­pli­es with the cur­rent legal requi­re­ments or in order to imple­ment chan­ges to our ser­vices in the data pro­tec­tion decla­ra­ti­on, e.g. when intro­du­cing new ser­vices. The new pri­va­cy poli­cy will then app­ly to your next visit.
